2. Definitions

• Customer means any individual, firm, proprietorship, company, or legal entity competent to enter into contracts under applicable Indian laws, who uses the Website to book, inquire about, or purchase Kia vehicles through SVM Cars.
• Dealer refers to SVM Cars Private Limited, authorized dealer of Kia Motors India Private Limited (KMI) for sale and service of Kia vehicles.
• Car means any model or variant of vehicles manufactured, imported, marketed, or sold by Kia Motors India Private Limited and available through SVM Cars.

3. Price of the Car

• The price of the Car will be as applicable on the date of the invoice issued by SVM Cars.
• Prices are subject to change without prior notice and are indicative only. On-road price information provided on the Website is for reference and may not reflect final payable amounts.
• Prices and offers are valid within the Chennai city limits only unless otherwise specified.
• Promotional offers, exchange bonuses, or discounts are applicable only as per the terms available at the time of delivery and full payment.

4. Booking of Car

• The online booking service is provided solely for Customer convenience.
• Bookings can only be made through SVM Cars Private Limited as the authorized dealer.
• Each booking request can be made for one Car at a time; multiple bookings require separate transactions.
• Customers must provide accurate and complete information in English while making bookings.
• If booking on behalf of another person, their details must also be provided and validated at the time of delivery.
• Customers agree to indemnify SVM Cars against any claims arising from incorrect or fraudulent booking information.

5. Acceptance of Payment Towards Booking

• A booking amount (“Booking Amount”) as displayed on the Website must be paid online at the time of booking.
• Payments can be made by Credit/Debit Card, Net Banking, Wallet, or UPI through a secure third-party payment gateway.
• SVM Cars facilitates the payment gateway but is not liable for any failure or dispute related to the payment processing.
• The Booking Amount will be transferred to SVM Cars’ account upon successful payment.
• SVM Cars reserves the right to limit or reject bookings based on prior customer transaction history or security concerns.
• Customers will receive a Booking Reference ID after successful payment, which must be used for all future communications regarding the booking.

6. Acceptance of Booking by SVM Cars

• The booking is a request and does not constitute a confirmed order until accepted by SVM Cars.
• Booking Amount will be adjusted against the final sale price upon invoice generation.
• The balance payment must be made as communicated by SVM Cars for the transaction to be completed.
• Failure to pay the balance amount timely may lead to cancellation or reallocation of the vehicle.
• Vehicle specifications, pricing, taxes, and levies will apply as per the date of invoice.

7. Delivery of Kia Car

• Delivery and all formalities including registration will be handled by SVM Cars.
• Insurance, permanent registration charges, and applicable taxes are the Customer’s responsibility.
• The Customer must produce all necessary documents during delivery.
• Delivery dates are indicative and depend on vehicle availability.
• The vehicle registration is subject to the Transport Authority’s discretion.
• Delivery will only be made after full payment realization and registration completion.

8. Cancellation and Refund

• Cancellation of booking can be requested online but not within 24 hours of booking.
• Refund of Booking Amount will be processed subject to deductions of applicable processing fees as specified by SVM Cars.
• No cash refunds will be issued; refunds will be processed through the original payment mode.
• Financing-related cancellations must be coordinated with the financing institution and SVM Cars.

9. General Terms

• Users must comply with all applicable laws including the Information Technology Act, 2000.
• Customers are responsible for maintaining confidentiality of login credentials and account information.
• SVM Cars may suspend or terminate access for providing false or incomplete information.
• Promotional offers are subject to separate terms and can be withdrawn without prior notice.
• Vehicle models, specifications, prices, and availability may change without prior notice.
• Online bookings are optional; Cars can also be booked directly at SVM Cars dealership.
• SVM Cars shall not be liable for any losses arising from online booking or payment issues.
• Delivery and performance are subject to “force majeure” events beyond the control of SVM Cars.

10. Limitation of Liability

• SVM Cars, its employees, directors, and partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the Website or services.

11. Governing Law and Jurisdiction

• These Terms shall be governed by the laws of India.
• All disputes shall be subject to the exclusive jurisdiction of courts in Chennai, Tamil Nadu.
